Welcome to WeFindWork! These Terms of Service ("Terms") govern your use of the website wefindwork.agency , wefindwork.co.za and its subdomains (the "Site"), and the services provided by WEFINDWORK AGENCY (Pty) Ltd ("WeFindWork," "we," "us," or "our").

By accessing our Site or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

1. Description of Services

WeFindWork provides services to help small and mid-sized US businesses scale efficiently by connecting them with exceptional South African customer service professionals for recruitment (the "Services"). This includes sourcing, screening, and presenting candidates to our business clients ("Clients").

2. User Accounts

To access certain features of our Services, such as a client portal, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Client Responsibilities and Employment Relationships

Clients agree to provide accurate information about their business and the roles they seek to fill. Clients are solely responsible for their hiring decisions, the terms of engagement with any candidate, and for complying with all applicable employment and labor laws in their jurisdiction.

• Direct Placements: For standard recruitment services, WeFindWork acts as a sourcing and recruiting platform; we are not a party to any employment agreement between a Client and a candidate.
• Managed Services via Employer of Record (EOR): For our full-time managed service offerings, candidates are employed by a third-party Employer of Record ("EOR"). The EOR is the legal employer, handling payroll, benefits, and compliance. The Client remains responsible for the candidate's day-to-day work management. The specific terms of the EOR relationship will be governed by your service agreement with WeFindWork.

4. Fees and Payment

• Payment: Clients agree to pay all fees for Services as described in their individual service agreement with WeFindWork.
• Payment Processors: We use third-party payment processors to bill you through a payment account linked to your account. Currently, we use GoCardless for ACH transfers, PayPal, and Stripe for credit card payments. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processors in addition to these Terms. We are not responsible for any errors by the Payment Processors.

5. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of WeFindWork or its licensors and is protected by South African and international copyright laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

6. Acceptable Use

You agree not to use the Site or Services for any unlawful purpose or to engage in any activity that would violate these Terms. You agree not to:

• Submit false or misleading information, including on resumes or in job descriptions.
• Interfere with the security or proper functioning of the Site.
